Terms and Conditions

Your User Agreement

The following describes the terms on which Mainely Auctions offers you access to our services.
Welcome to Mainely Auctions. By using the services on the Mainely Auctions websites ( and other related websites where this agreement appears) (the “Sites”), you are agreeing to the following terms, including those available by hyperlink, (the "Agreement" or "User Agreement") with Mainely Auctions. and the general principles for the websites of our subsidiaries and international affiliates.
Before you may become a member of Mainely Auctions, you must read and accept all of the terms and conditions in, and linked to, this User Agreement and the Privacy Policy. We strongly recommend that, as you read this User Agreement. By accepting this User Agreement, you also agree that your use of some Mainely Auctions-branded websites or websites we operate may be governed by separate user agreements and privacy policies. The agreement that applies on any of our domains and subdomains is always the agreement that appears in the footer of each website.
This Agreement is effective on May 29, 2008, for current users, and upon acceptance for all.
Using Mainely Auctions
While using the Sites, you will not:
• post content or items in an inappropriate category or areas on the Sites;
• violate any laws, third party rights, or our policies such as the Prohibited and Restricted Items policies;
• use the Sites if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from our Sites;
• fail to deliver payment for items purchased by you, unless the seller has materially changed the item's description after you bid, a clear typographical error is made, or you cannot authenticate the seller's identity;
• fail to deliver items purchased from you, unless the buyer fails to meet the posted terms, or you cannot authenticate the buyer's identity;
• manipulate the price of any item or interfere with other user's listings;
• circumvent or manipulate our fee structure, the billing process, or fees owed to Mainely Auctions;
• post false, inaccurate, misleading, defamatory, or libelous content (including personal information);
• take any action that may undermine the feedback or ratings systems (such as displaying, importing or exporting feedback information off of the Sites or for using it for purposes unrelated to Mainely Auctions);
• transfer your Mainely Auctions account (including feedback) and User ID to another party without our consent;
• distribute or post spam, chain letters, or pyramid schemes;
• distribute viruses or any other technologies that may harm Mainely Auctions, or the interests or property of Mainely Auctions users;
• copy, modify, or distribute content from the Sites and Mainely Auctions’ copyrights and trademarks; or
• harvest or otherwise collect information about users, including email addresses, without their consent.
Abusing Mainely Auctions
Mainely Auctions and the Community work together to keep the Sites working properly and the Community safe. Please report problems, offensive content, and policy violations to us.
Without limiting other remedies, we may limit, suspend, or terminate our service and user accounts, prohibit access to our website, delay or remove hosted content, and take technical and legal steps to keep users off the Sites if we think that they are creating problems, possible legal liabilities, or acting inconsistently with the letter or spirit of our policies. We also reserve the right to cancel unconfirmed accounts or accounts that have been inactive for a long time.
Fees and Services
Joining Mainely Auctions and bidding on listed items is free. We do charge fees for using other services, such as listing items. When you list an item or use a service that has a fee you have an opportunity to review and accept the fees that you will be charged based on our Fees schedule, which we may change from time to time. Changes to that Policy are effective after we provide you with at least fourteen days' notice by posting the changes on the Sites. We may choose to temporarily change the fees for our services for promotional events (for example, free listing days) or new services, and such changes are effective when we post the temporary promotional event or new service on the Sites.
Unless otherwise stated, all fees are quoted in U.S. Dollars. You are responsible for paying all fees and applicable taxes associated with the Sites in a timely manner with a valid payment method. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms. (This includes charging other payment methods on file with us, retaining collection agencies and legal counsel, and for accounts over 180 days past due, deducting the amount owed from your PayPal account balance.)
Content License
When you give us content, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise the copyright, publicity, and database rights (but no other rights) you have in the content, in any media known now or in the future.
You will not hold Mainely Auctions responsible for other users' actions or inactions, including things they post. You acknowledge that we are not a traditional auctioneer. Instead, the Sites are a venue to allow anyone to offer, sell, and buy just about anything, at anytime, from anywhere, in a variety of pricing formats and venues, such as stores, fixed price formats and auction-style formats. We are not involved in the actual transaction between buyers and sellers. We have no control over and do not guarantee the quality, safety or legality of items advertised, the truth or accuracy of listings, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer or seller will actually complete a transaction.
We do not transfer legal ownership of items from the seller to the buyer, and nothing in this agreement shall modify the governing provisions of Maine Commercial Code and Uniform Commercial Code, under which legal ownership of an item is transferred upon physical delivery of the item to the buyer by the seller. Unless the buyer and the seller agree otherwise, the buyer will become the item's lawful owner upon physical receipt of the item from the seller, in accordance with Maine Commercial Code and Uniform Commercial Code. Further, we cannot guarantee continuous or secure access to our services, and operation of the Sites may be interfered with by numerous factors outside of our control. Accordingly, to the extent legally permitted, we exclude all implied warranties, terms and conditions. We are not liable for any loss of money, goodwill, or reputation, or any special, indirect, or consequential damages arising out of your use of our Sites. Some jurisdictions do not allow the disclaimer of warranties or exclusion of damages, so such disclaimers and exclusions may not apply to you.
Regardless of the previous paragraph, if we are found to be liable, our liability to you or to any third party is limited to the greater of (a) the total fees you paid to us in the 12 months prior to the action giving rise to the liability, and (b) $100.
If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes. If you are a Maine resident, you waive Maine Civil Code.
Access and Interference
The Sites contains robot exclusion headers. Much of the information on the Sites is updated on a real-time basis and is proprietary or is licensed to Mainely Auctions by our users or third parties. You agree that you will not use any robot, spider, scraper or other automated means to access the Sites for any purpose without our express written permission.
Additionally, you agree that you will not:
• take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on our infrastructure;
• copy, reproduce, modify, create derivative works from, distribute, or publicly display any content (except for Your Information) from the Sites without the prior expressed written permission of Mainely Auctions and the appropriate third party, as applicable;
• interfere or attempt to interfere with the proper working of the Sites or any activities conducted on the Sites; or
• bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the Sites.
We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We use your information only as described in the Mainely Auctions Privacy Policy. We view protection of users' privacy as a very important community principle. We store and process your information on computers located in the United States that are protected by physical as well as technological security devices. You can access and modify the information you provide us and choose not to receive certain communications by signing-in to your account.. If you object to your Information being transferred or used in this way please do not use our services.
You will indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees), harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement, or your violation of any law or the rights of a third party.
No Agency
No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
Except as explicitly stated otherwise, legal notices shall be served to the email address you provide to Mainely Auctions during the registration process (in your case). Notice shall be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid. Alternatively, we may give you legal notice by mail to the address provided during the registration process. In such case, notice shall be deemed given three days after the date of mailing.
Resolution of Disputes
If a dispute arises between you and Mainely Auctions, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. Accordingly, you and Mainely Auctions agree that we will resolve any claim or controversy at law or equity that arises out of this Agreement or our services (a "Claim") in accordance with one of the subsections below or as we and you otherwise agree in writing. Before resorting to these alternatives, we strongly encourage you to first contact us directly to seek a resolution by emailing We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
• Law and Forum for Disputes - This Agreement shall be governed in all respects by the laws of the State of Maine as they apply to agreements entered into and to be performed entirely within Maine between Maine residents, without regard to conflict of law provisions. You agree that any claim or dispute you may have against Mainely Auctions must be resolved by a court located in Kennebec County, Maine, except as otherwise agreed by the parties or as described in the Arbitration Option paragraph below. You agree to submit to the personal jurisdiction of the courts located within Kennebec County, Maine for the purpose of litigating all such claims or disputes.
• Arbitration Option - For any claim (excluding claims for injunctive or other equitable relief) where the total amount of the award sought is less than $10,000, the party requesting relief may elect to resolve the dispute in a cost effective manner through binding non-appearance-based arbitration. In the event a party elects arbitration, they shall initiate such arbitration through an established alternative dispute resolution ("ADR") provider mutually agreed upon by the parties. The ADR provider and the parties must comply with the following rules: a) the arbitration shall be conducted by telephone, online and/or be solely based on written submissions, the specific manner shall be chosen by the party initiating the arbitration; b) the arbitration shall not involve any personal appearance by the parties or witnesses unless otherwise mutually agreed by the parties; and c) any judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.
• Improperly Filed Claims - All claims you bring against Mainely Auctions must be resolved in accordance with this Resolution of Disputes Section. All claims filed or brought contrary to the Resolution of Disputes Section shall be considered improperly filed. Should you file a claim contrary to the Resolution of Disputes Section, Mainely Auctions may recover attorneys' fees and costs up to $1000, provided that Mainely Auctions has notified you in writing of the improperly filed claim, and you have failed to promptly withdraw the claim.
We may amend this Agreement at any time by posting the amended terms on this Site. Except as stated elsewhere, all amended terms shall automatically be effective 30 days after they are initially posted. Additionally, we will notify you through the Mainely Auctions Message Center. This Agreement may not be otherwise amended except in a writing signed by you and us. This Agreement sets forth the entire understanding and agreement between us with respect to the subject matter hereof. The following Sections survive any termination of this Agreement: Fees and Services (with respect to fees owed for our services), Release, Content License, Liability, Indemnity and Resolution of Disputes.
Mainely Auctions Privacy Policy

This Privacy Policy describes how we handle your personal information for our services on the Mainely Auctions websites. It applies generally to the Mainely website and other related websites where this policy appears in the footer of the page. Some Mainely Auctions-branded websites or websites we operate may be governed by separate privacy policies. The policy that applies on any of our domains or subdomains is always the policy that appears in the footer of each website.
Our subsidiaries’ and joint ventures’ privacy practices are similar to those described in this Privacy Policy. Subject to the requirements of applicable law, we strive to provide a consistent set of privacy practices throughout the global Mainely Auctions trading community. By accepting the Privacy Policy and the User Agreement in registration, you expressly consent to our collection, storage, use and disclosure of your personal information as described in this Privacy Policy. This Privacy Policy is effective upon acceptance for new users and is otherwise effective on July 9, 2007.
You can browse our sites without telling us who you are or revealing any personal information about yourself. Once you give us your personal information, you are not anonymous to us. If you choose to provide us with personal information, you consent to the transfer and storage of that information on our servers located in the United States.
We may collect and store the following personal information:
• email address, physical contact information, and (depending on the service used) sometimes financial information, such as credit card or bank account numbers;
• transactional information based on your activities on the sites (such as bidding, buying, selling, item and content you generate or that relates to your account);
• shipping, billing and other information you provide to purchase or ship an item;
• community discussions, chats, dispute resolution, correspondence through our sites, and correspondence sent to us;
• other information from your interaction with our sites, services, content and advertising, including computer and connection information, statistics on page views, traffic to and from the sites, ad data, IP address and standard web log information;
• information from other companies, such as demographic and traffic data; and
• other supplemental information from third parties (for example, if you incur a debt to Mainely Auctions, we will generally conduct a credit check by obtaining additional information about you from a credit bureau, as permitted by law; or if the information you provide cannot be verified, we may ask you to send us additional information, such as your driver license, credit card statement, or a recent utility bill or other information confirming your address, or to answer additional questions online to help verify your information).
We don't sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve and personalize our services, content and advertising. If you don't wish to receive marketing communications from us or participate in our ad-customization programs, simply indicate your preference once you sign-on in My Mainely Auctions (or similar account status page) or by following the directions provided in an email or from a link on the advertisement.
Our primary purpose in collecting personal information is to provide you with a safe, smooth, efficient, and customized experience. You agree that we may use your personal information to:
• provide the services and customer support you request;
• resolve disputes, collect fees, and troubleshoot problems;
• prevent potentially prohibited or illegal activities, and enforce our User Agreement;
• customize, measure and improve our services, content and advertising;
• tell you about targeted marketing, service updates, and promotional offers based on your communication preferences; and
• compare information for accuracy, and verify it with third parties.
Our Disclosure of Your Information
We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that a listing or other content violates the rights of others, or protect anyone's rights, property, or safety.
We may also share your personal information with:
• Members of our corporate family to help detect and prevent potentially illegal acts and provide joint content and services (for example, registration, transactions and customer support). Our corporate affiliates will send marketing communications only to users who request these services.
• Service providers under contract who help with our business operations (such as fraud investigations, bill collection, affiliate and rewards programs and co-branded credit cards).
• Other third parties to whom you explicitly ask us to send your information (or about whom you are otherwise explicitly notified and consent to when using a specific service).
• Law enforcement or other governmental officials, in response to a verified request relating to a criminal investigation or alleged illegal activity. In such events, we will disclose information relevant to the investigation, such as name, city, state, zip code, telephone number, email address, User ID history, IP address, fraud complaints, and bidding and listing history.
• Other business entities, should we plan to merge with or be acquired by that business entity. (Should such a combination occur, we will require that the new combined entity follow this privacy policy with respect to your personal information. If your personal information will be used contrary to this policy, you will receive prior notice.)
Without limiting the above, in an effort to respect your privacy and our ability to keep the community free from bad actors, we will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a subpoena, court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.
Activity Associated with User IDs
Your User ID is displayed throughout Mainely Auctions and is therefore available to the public. All of your activity on our sites is traceable to your User ID. Other people can see your bids, items that you have purchased in the past, items for sale, storefronts, feedback, ratings and associated comments, and so on. Notices are sent to other community members regarding suspicious activity and policy violations on our sites and refer to User IDs and specific items. Therefore, if you associate your name with your User ID, the people to whom you have revealed your name will be able to personally identify your Mainely Auctions activities.
Using Information from Mainely Auctions
Mainely Auctions enables you to share personal and financial information to complete transactions. We encourage you to disclose your privacy practices and respect the privacy of other users. We cannot guarantee the privacy or security of your information and therefore we encourage you to evaluate the privacy and security policies of your trading partner before entering into a transaction and choosing to share your information. To help protect your privacy, we allow only limited access to other users' contact, shipping and financial information to facilitate your transactions. When users are involved in a transaction, they may have access to each other's name, User ID, email address and other contact and shipping information. In all cases, you must give other users a chance to remove themselves from your database and a chance to review what information you have collected about them.
You agree to use user information only for:
• Mainely Auctions transaction-related purposes that are not unsolicited commercial messages;
• using services offered through Mainely Auctions (e.g. escrow, insurance, shipping and fraud complaints), or
• other purposes that a user expressly chooses.
We use "cookies" (small files placed on your hard drive) on certain of our pages to help analyze our web page flow; customize our services, content and advertising; measure promotional effectiveness, and promote trust and safety. A few important things you should know about cookies are that:
• We offer certain features that are available only through the use of cookies.
• We use cookies to help identify you and maintain your signed-in status.
• Most cookies are "session cookies," meaning that they are automatically deleted from your hard drive at the end of a session.
• You are always free to decline our cookies if your browser permits, although doing so may interfere with your use of some of our sites or services.
• You may encounter cookies from third parties on certain pages of the sites that we do not control. (For example, if you view a web page created by another user, there may be a cookie placed by that web page.)
No Spam, Spyware or Spoofing
We and our users do not tolerate spam. Make sure to set your Mainely Auctions notification preferences so we communicate to you as you prefer. You are not licensed to add other Mainely Auctions users, even a user who has purchased an item from you, to your mailing list (email or physical mail) without their express consent. To report Mainely Auctions-related spam or spoof emails to Mainely Auctions, please forward the email to You may not use our communication tools to send spam or otherwise send content that would violate our User Agreement. We automatically scan and may manually filter messages to check for spam, viruses, phishing attacks and other malicious activity or illegal or prohibited content, but we do not permanently store messages sent through these tools. If you send an email to an email address that is not registered in our community (via Refer-a-Friend or other tools), we do not permanently store that email or use that email address for any marketing purpose. We do not rent or sell these email addresses.
Account Protection
Your password is the key to your account. Use unique numbers, letters and special characters, and do not disclose your Mainely Auctions password to anyone. If you do share your password or your personal information with others, remember that you are responsible for all actions taken in the name of your account. If you lose control of your password, you may lose substantial control over your personal information and may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately notify Mainely Auctions and change your password.
Accessing, Reviewing and Changing Your Personal Information
You can see, review and change most of your personal information by signing on to Mainely Auctions. Generally, we will not manually modify your personal information because it is very difficult to verify your identity remotely. You must promptly update your personal information if it changes or is inaccurate. Once you make a public posting, you may not be able to change or remove it. Upon your request, we will close your account and remove your personal information from view as soon as reasonably possible, based on your account activity and in accordance with applicable law. We do retain personal information from closed accounts to comply with law, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Mainely Auctions User Agreement, and take other actions otherwise permitted by law.
Your information is stored on our servers located in the United States. We treat data as an asset that must be protected and use lots of tools (encryption, passwords, physical security, etc.) to protect your personal information against unauthorized access and disclosure. However, as you probably know, third parties may unlawfully intercept or access transmissions or private communications, and other users may abuse or misuse your personal information that they collect from the site. Therefore, although we work very hard to protect your privacy, we do not promise, and you should not expect, that your personal information or private communications will always remain private.
Third Parties
Except as otherwise expressly included in this Privacy Policy, this document addresses only the use and disclosure of information we collect from you. If you disclose your information to others, whether they are bidders, buyers or sellers on our sites or other sites throughout the internet, different rules may apply to their use or disclosure of the information you disclose to them. Mainely Auctions does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. We encourage you to ask questions before you disclose your personal information to others.

Community Content Policy

Mainely Auctions provides members a wide variety of forums, such as, but not limited to, Reviews, Guides, Forum Entries, Wiki Articles, and Member-Created Product Descriptions, to enable our members to provide factual information, personal opinions about products, and guidance on a variety of topics; and to publish other personal commentary and content on our site.
Community content published or edited by Mainely Auctions Community members is solely the opinion and responsibility of the person posting the content. All content posted to one of these forums must comply with all aspects of the Mainely Auctions User Agreement and this policy.
See the Examples section below for examples of content that is not permitted. These examples are designed to provide guidance when self-publishing content on our site and should not be viewed as an exhaustive list.
Exceptions to these policies may be found in the Additional Information section of this page..
Violations of Mainely Auctions policies, including this policy, may result in a range of actions, including:
• Content removal
• Listing cancellation
• Forfeit of Mainely Auctions fees on cancelled listings
• Limits on account privileges
• Account suspension.

Some Examples
The following are examples of content or actions not permitted in the Community content areas (Reviews, Guides, Forum Entries, Wiki Articles, and Member-Created Product Descriptions):
• Promoting or advertising to buy, sell, or trade any product or service listed or located outside of any Mainely Auctions property (Mainely Auctions, Mainely Auctions Stores, Mainely Auctions Express, etc.). Sellers may only promote their Store or Sellers Other Items list, not individual listings.
• Placing published content in the wrong category (mis-categorization).
• Using another Mainely Auctions member's pictures or text without the other member's express permission.
• Using intellectual property without the property owners express permission, where applicable. Mainely Auctions strongly encourages members writing and publishing content to familiarize themselves with how Mainely Auctions helps protect intellectual property
• Including any advertising credit, including links, logos, or company names within published content.
• Publishing more than one identical piece of content concurrently.
• Encouraging, promoting, facilitating, or instructing others to engage in illegal activity or to violate Mainely Auctions policy.
• Enabling, encouraging, or instructing others to infringe copyrights, trademarks, or other intellectual property rights.
• Promoting giveaways, lotteries, random drawings, raffles, or prizes of any kind.
• Using HTML and JavaScript functions prohibited on Mainely Auctions.
• Using keywords, random links, inaccurate titles, text, or other content not directly relevant to the subject of the Community content for the purpose of gaining attention or diverting members to that content.
• Publishing content or images that are adult in nature or otherwise not appropriate for minors (individuals under 18 years of age).
• Linking from content published on Mainely Auctions to Web sites that include offers to trade, sell, or purchase goods or services off Mainely Auctions is generally not permitted. Please see Additional Information below for exceptions with Forums.
• Linking to items, services, or content prohibited on Mainely Auctions or to sites that offer items, services, or content prohibited on Mainely Auctions.
• Misrepresenting yourself as an Mainely Auctions employee or as another Mainely Auctions member.
• Publishing content that promotes or glorifies hatred, violence, racial, or religious intolerance, or content that promotes organizations with such views
• Using profanity or patently vulgar language in a public area of the site.
• Publishing personal contact information of any person in any public area of Mainely Auctions, including emails, phone numbers, name, street address, etc.
• Misusing the violation reporting function to maliciously or frivolously report content as not in compliance with Mainely Auctions policy.
• Artificially increasing or decreasing any Community Content ratings using the voting features.
Additional Information
Exceptions for Forum use
• Use of profanity (not patently vulgar language, hate speech, or adult material) in the context of a Forum will generally be permitted; however, excessive and inappropriate use is discouraged. Remember, you are responsible for all content you publish.
• Members publishing Forums may include links to sites that offer goods for sale off Mainely Auctions, as long as they do not promote outside-of-Mainely Auctions sales or prohibited items; nor may the Forum contain links to commercial Web sites where goods from multiple sellers are aggregated by a common search engine.
Exceptions for Reviews
• When reviewing a product where the title contains a profane or vulgar term (e.g., a CD with a profane term in the title), the reviewer may use the term, but only in the context of the title.
Why does Mainely Auctions have this policy?
Mainely Auctions provides the Community content areas of the site to promote Community interaction by giving members the opportunity to express their individual views and share helpful information. When publishing content, especially individual commentary or opinion, it is important for members of the Community to respect each other as human beings and follow societal norms. Content that contains or promotes hate, illegal acts, violence, or racial intolerance (or organizations dedicated to such notions) has no place in the Mainely Auctions Community and is prohibited.
Rules for Listings – Overview
To promote a safe, fair and enjoyable trading experience, Mainely Auctions has established a set of rules and policies for item listings. These restrictions involve how certain items are described, and practices that would provide an unfair advantage or result in a negative buyer experience.
Learning about Mainely Auctions’ listing policies before you list an item will help you to avoid unintentionally breaking rules.
Violations of these policies may result in a range of actions, including:
• Listing cancellation
• Limits on account privileges
• Account suspension
• Forfeit of Mainely Auctions fees on cancelled listings
• Loss of PowerSeller status.
When policy violations occur, Mainely Auctions emails the seller, as well as bidders, that a listing has been ended.
In addition to the Rules for Listings, you should also review the rules for Prohibited and Restricted Items and the Protection of Intellectual Property to check if your type of item is allowed or has additional restrictions that would affect your item listing.
The following are the Rules for Listing with links to the specific policy pages that have examples, any exceptions, and a link that you can use to report a violation of that policy.
Listings must not misrepresent items.
Except as noted in the specific policy as exceptions, sellers cannot:
• List items in inappropriate categories.
• Misrepresent the item location from which their item will be shipped.
• Include brand names or other inappropriate keywords in a title or description. This is known as keyword spamming.
• Have misleading titles that do not accurately describe the item for sale.
Listings cannot use techniques to avoid or circumvent Mainely Auctions fees.
Except as noted in the specific policy as exceptions, sellers cannot:
• Offer a catalog from which buyers may directly order.
• Allow buyers a choice of items.
• List a single item but offer additional identical items for sale in the item description.
• Include separate payment surcharges that buyers pay to use ordinary forms of payment.
• Misuse the Reserve Price option.
• Charge excessive shipping.
• Offer the opportunity through Mainely Auctions to purchase the item or other merchandise.
Listings must promote a fair and level playing field, and provide an enjoyable and safe experience for buyers.
Except as noted in the specific policy as exceptions, sellers cannot:
• Solicit buyers to mail cash or use other payment methods not specifically permitted by Mainely Auctions as accepted payment methods.
• Communicate to buyers that they accept, or will not accept, specific forms of PayPal payment.
• Include links that do not conform to Mainely Auctions’ Links Policy. Specific types of links that are limited include links to further descriptions, email address, photos, your About Me page, listing terms and conditions and Mainely Auctions Stores.
• Use certain types of HTML and JavaScript in item listings, Stores pages, About Me pages, or Want-It-Now ads.
• Promote giveaways, random drawings, raffles, prizes or bonuses.
• Create a listing that does not offer an item or service.
• Advertise a desire to buy or trade items, except as allowed in non-binding bid categories and in Want It Now.
• Include third-party endorsements of Mainely Auctions members.
• Include third party credits beyond what is acceptable.
• Create test listings except in the Everything Else; Test Auctions category.
• Use profanity in a listing, except as allowed in the Mature Audience category and in media titles.
Listings that involve the following situations or types of item, must conform to limitations specified in the policy:

Prohibited and Restricted Items - Overview

Before you list your item, you need to find out if your item is allowed on Mainely Auctions and if the type of item is subject to certain restrictions to avoid potential issues with your listing. As a Mainely Auctions seller, you are ultimately responsible for making sure that selling an item is legal in the eyes of the law.
Violations of these policies may result in a range of actions, including:
• Listing cancellation
• Limits on account privileges
• Account suspension
• Forfeit of Mainely Auctions fees on cancelled listings
When policy violations occur, Mainely Auctions emails the seller, as well as bidders, that a listing has been ended. You may contact Mainely Auctions to report violations by emailing
Understanding the rules about prohibited and restricted items
• Policies about listing items are often based on country and state laws. However, many restrictions may involve the sale of dangerous or sensitive items and are not necessarily prohibited by law.
• When selling across borders, be aware of international trading and import restrictions. Certain items may be legal in your country, but may be illegal elsewhere.
• Just because a particular type of item is listed below, it does not mean that it is completely prohibited. For example

Outage Policy

Mainely Auctions’ highest priority is its members’ trading success. However, the Mainely Auctions site occasionally experiences outages during which bidders cannot place bids or effectively locate items via our Title Search function. When outages occur that are at least one hour in duration, Mainely Auctions offers this Outage Policy to compensate for member inconvenience.

Some Examples
Hard outage of more than one but less than two hours
In the event of a hard outage of more than one but less than two hours, Mainely Auctions automatically credits all associated fees for affected listings. The following listings will be eligible for credit:
• Any listing scheduled to end during the outage
• Any listing scheduled to end in the hour after the end of the outage
Additionally, credit will be issued for the 10-cent Promotional Fee on any 10-day listing that is running during the outage (regardless of the time it's scheduled to end). This includes either of the following features:
• Item pages
• Bidding
Unlike our policy for hard outages of two hours or more, listings will not be extended.
Hard outage of two hours or more
In the event of a hard outage of two hours or more, Mainely Auctions automatically extends listings for 24 hours. Mainely Auctions also automatically credits all associated fees for affected listings. The following listings will be eligible for extension and credit:
• Any listing scheduled to end during the outage
• Any listing scheduled to end in the hour after the end of the outage
Additionally, credit will be issued for the 10-cent Promotional Fee on any 10-day listing that is running during the outage (regardless of the time it's scheduled to end). This includes either one or all of the following features:
• Item pages
• Bidding
What does Mainely Auctions consider to be a hard outage?
A hard outage occurs when no one can bid or buy (specifically View Item pages are inaccessible and/or bidding functionality is not available) as a result of unscheduled system downtime. At our discretion, Mainely Auctions may consider two outages that occur very closely to one another to be one hard outage when extending listings.
Listings that end prior to an outage will not be extended.
During an outage
Updates will be posted on the News Board during an outage. Please check there for details about the outage and possible listing extensions.
When listings are extended
Following a hard outage of two or more hours, Mainely Auctions will extend the end times for all eligible listings by 24 hours. This prevents bidding on these listings while the end times are being reset. After the listing end times have been reset, Mainely Auctions updates search and listing indexes. Until these index updates are completed, these listings will be unavailable via search or listings. This re-indexing can take a few hours.
Why does Mainely Auctions have this policy?
There are many events, from natural disasters to power outages that can disrupt bidding and finding on Mainely Auctions. When a lengthy outage occurs and the cause was under Mainely Auctions’ direct control, Mainely Auctions does not believe sellers should incur their Mainely Auctions fees for those listings that were most affected.
Reporting Inappropriate Trading Behavior

The Mainely Auctions Investigations team tries to resolve reported cases of inappropriate trading behavior. Mainely Auctions will consider the circumstances of an alleged offense and the user's trading record before taking action. Disciplinary action may range from a formal warning up to indefinite suspension of a user's account. However, out of fairness to all users, if a complaint cannot be proven with certainty, Mainely Auctions will not take action.

How to report specific trading offenses
• Make sure that your complaint relates to a subject that Mainely Auctions investigates by reviewing the offenses explained on this page.
• When you contact Mainely Auctions, please include the information we need to investigate, plus any emails with full descriptions in the subject line.
• Only report a case once. Multiple emails about the same case will slow the investigation.
• Once you notify the Investigations team, Mainely Auctions may contact you to tell you the investigation is complete. However, please remember that because we respect the privacy rights of all our users, Mainely Auctions can't discuss results in detail.
• To report a listing, use the “report” links on the policy pages that are applicable to the offense. For example, Mainely Auctions prohibits email offers to buy or sell listed items outside of the Mainely Auctions Web site. To report a seller offering to sell you items outside of Mainely Auctions, you would go to the Offers to buy or sell outside of Mainely Auctions policy page and use the “contact Mainely Auctions” link.

Violations of Mainely Auctions policies may result in a range of actions, including:
• Listing or Want It Now post cancellation
• Limits on account privileges

Note: If you offered an item on Mainely Auctions and did not receive payment from the purchaser, you may sell the item to another bidder using Second Chance Offer.

• Underage user
Note: While multiple User IDs are allowed, it is never permissible for those User IDs to interact with one another. For example, members cannot bid on their own auctions or leave comments on their own Feedback Profile.
Miscellaneous offenses
• Interfering with Mainely Auctions's site and/or operations
• Sending spam
• Email threats
• Publishing contact information
• Use of profanity or patently vulgar language
What Mainely Auctions does not investigate
Mainely Auctions doesn't investigate simple misunderstandings, failure to communicate, and interpersonal disputes over which Mainely Auctions has no control. Here are some examples of other things that Mainely Auctions doesn't investigate:
• The buyer left a negative Feedback for me even after I left positive Feedback for them.

Per the User Agreement, Mainely Auctions will not remove these comments.
• The seller is charging too much shipping. The seller insists that I pay in advance or unhide my Feedback before accepting my bid.

If the seller has a stated policy concerning shipping and payment terms on the item listing or storefront, then you as a potential buyer must clear any exceptions to this before actually entering into the transaction.
• The seller refuses to answer my emails, they will not acknowledge my valid transaction, or they have already sold the item.

Mainely Auctions cannot force a seller to honor their transactions. You should leave appropriate Feedback for the reluctant seller to warn other buyers of his or her past history. Depending on your local jurisdiction, you may have independent legal recourse against the seller.
• The buyer insists that I ship COD, accept a third party post-dated check or box each item separately.

Mainely Auctions cannot force a buyer to honor the transaction. But you can alert the rest of the Mainely Auctions Community to your experience by leaving the buyer appropriate Feedback. You may also either offer the item to the next bidder or you may relist it and request a credit for the Final Value Fee.
• Bid Sniping (last minute bidding).

We always recommend bidding the absolute maximum you are willing to pay for an item. Mainely Auctions uses a proxy bidding system, so you may bid as high as you wish, but the current bid that is registered will only be a small increment above the next lowest bid. The remainder of your Maximum Bid is held, by the system, to be used in the event someone bids against you.
• Almost everything else that is not in the list of offenses, we will investigate.
